Bombay HC Declares Arrest of Mumbai Businessman in Tardeo Rape Case Illegal

On June 30, the Bombay High Court declared the arrest of a Mumbai businessman by the Tardeo Police in a rape and extortion case illegal, quashing his arrest and subsequent remand orders. Justice Shyam Chandak ruled that the police had failed to comply with the mandatory constitutional requirement of providing the accused with proper written grounds of arrest before presenting him before a magistrate.

Justice Chandak quashed the businessman's arrest alongside the remand orders passed on May 22, 25, and 28, 2026. The court found that the police's failure to provide specific factual grounds violated Articles 21 and 22 of the Constitution of India, as well as provisions of the Bharatiya Nagarik Suraksha Sanhita.

The case arose from an FIR registered by the Tardeo Police. The female complainant, a family friend, alleged that the businessman secretly took obscene photographs of her during a family trip to London in August 2024. She claimed he later used those images to blackmail and repeatedly sexually assault her, and demanded Rs 50 lakh to delete the objectionable videos before she filed the FIR in May 2026.

The businessman challenged his arrest, arguing that while the police informed him of the statutory provisions invoked against him, they failed to communicate the specific factual grounds for his arrest. The High Court accepted this contention, noting that the police communication merely stated a complaint had been filed and that the accused was involved, which did not disclose the basic facts necessary to enable him to effectively seek bail or oppose custodial remand.

Justice Chandak observed that the communication issued by the police was not sufficient or a substantive compliance of the legal requirement of informing the grounds of arrest. The judge also noted that the magistrate had failed to record satisfaction that the constitutional safeguards had been complied with before authorising police custody.

While declaring the arrest illegal due to these procedural lapses, the High Court clarified that it had not examined the merits of the criminal allegations. The court granted liberty to the state to take fresh action and arrest the businessman again in accordance with the law if a case is made out.
