Bombay High Court Pulls Up Maharashtra FDA Over Excessive Raids on Eateries

The Bombay High Court in Mumbai on Tuesday criticized the Maharashtra Food and Drug Administration over its drastic actions against local food establishments, directing the regulator to exercise its powers judiciously.

Observing that the authority is "using a sword to kill a mosquito" and "shoots first" before asking questions, the high court cautioned the agency against taking disproportionate measures. The court noted that several instances of drastic actions by the regulator have come to its notice, warning that it would consider imposing heavy costs if such actions continue.

The regulatory body has recently been involved in a slew of raids on food establishments, including several famous eateries, following the appointment of IAS officer Tukaram Mundhe at its helm in May.

Advising the agency to act systematically, the court urged the Maharashtra FDA to adopt a disciplined approach to regulation rather than resorting to immediate, heavy-handed measures against businesses.
