Maharashtra Rules Transferred Schools Keep Original Non Minority Status

The Maharashtra government issued a clarification on Thursday in Mumbai stating that a non-minority school will not acquire minority status simply because its management is transferred to a minority educational institution. The decision, released through an official government resolution by the school education department, aims to resolve ongoing confusion regarding school administration and minority protections across the state.
According to the newly issued government resolution, the school education department confirmed that a school’s original character will remain completely unchanged even after its transfer to a new managing body. As a result of this decision, these transferred schools will not become eligible for the specific protections and benefits that are legally reserved for minority-established institutions in Maharashtra.
This official order seeks to settle what the state government described as confusion at the field level. A previous policy established in 2012 permits the management of schools to be transferred between minority and non-minority educational bodies by mutual consent. However, this 2012 policy had raised several questions among local officials and educational institutions. Specifically, stakeholders were unsure whether a school could inherit the minority status of the trust taking over its administration.
To resolve these questions, the government has now drawn a clear and formal distinction between the identity of the managing trust and the identity of the school itself. The school education department emphasized that minority status requires an institution to have been both established and administered by a religious or linguistic minority.
The government clarified that a trust that assumes management of a school at a later date may satisfy the administration test. However, such a trust cannot retrospectively claim to have established the school. Because both establishment and administration by a religious or linguistic minority are required, the school's original non-minority status must remain.
