MahaRERA Rejects Jangid Homes Bid To Dismiss 17 Jogeshwari East Project Complaints

The Maharashtra Real Estate Regulatory Authority (MahaRERA) has officially rejected an application by developer Jangid Homes Pvt Ltd to dismiss 17 buyer complaints regarding the delayed Jangid Annexe project in Jogeshwari East, Mumbai. The ruling, which was delivered on June 28, 2026, establishes that the complaints filed by the unit purchasers are prima facie maintainable.

The dispute centers on the long-delayed Jangid Annexe project, which is located in the Jogeshwari East area of Mumbai. A group of 17 unit purchasers filed complaints against the developer, Jangid Homes Pvt Ltd, to address the ongoing delays associated with the real estate project.

In its application to dismiss the cases, the promoter argued that the units in question were industrial units. Based on this industrial classification, Jangid Homes Pvt Ltd contended that the units fell outside the jurisdiction of MahaRERA, meaning the authority had no legal ground to hear the buyers' complaints.

However, MahaRERA Member-II Ravindra Deshpande rejected the developer's bid to dismiss the complaints. In the official ruling, Deshpande observed that the builder had repeatedly represented the Jangid Annexe project and the units as commercial in nature. These representations were made by the developer both directly to the purchasers and before MahaRERA itself.

Because the developer had consistently represented the project as commercial, the authority ruled that the complaints are maintainable under its jurisdiction.

The order sets a significant precedent for buyer protection under the Real Estate (Regulation and Development) Act (RERA). By preventing developers from avoiding regulatory jurisdiction through property reclassification arguments, the decision strengthens protections for buyers facing project delays.
