MREAT Orders Veena Realcon to Ensure Usable Parking at Chembur Housing Project

The Maharashtra Real Estate Appellate Tribunal (MREAT) on July 13, 2026, officially refused to grant a stay on a MahaRERA order that directed developer Veena Realcon Pvt Ltd to ensure flat buyers at its Veena Serenity project in Chembur, Mumbai, can actually use their allotted parking spaces.
The ruling by MREAT establishes an important standard for housing developments in the state, clarifying that a builder’s responsibility does not simply end with allotting parking spaces on paper. Instead, developers must ensure that homebuyers can practically use their allotted physical parking spaces.
The dispute arose at the Veena Serenity housing project, located in the Chembur area of Mumbai. Homebuyers at the project had raised issues regarding their ability to use the parking spaces that had been assigned to them. MahaRERA had previously stepped in and ordered the developer, Veena Realcon Pvt Ltd, to ensure that the flat buyers could actually access and use these spaces.
Seeking relief, the developer appealed to the Maharashtra Real Estate Appellate Tribunal (MREAT) to stay the MahaRERA order. However, the appellate tribunal rejected the developer's request for a stay.
In its ruling, the tribunal made it clear that merely allotting a parking space on paper is not enough if the homebuyers are ultimately prevented from using it. The appellate tribunal upheld the original MahaRERA directive, reinforcing that developers are obligated to provide usable physical parking spaces to the buyers.
This decision marks a significant clarification of developer responsibilities under real estate regulations. It confirms that paper allotments must translate to practical, usable physical spaces for flat owners, ensuring that homebuyers receive the full utility of the properties they purchase.
With this decision, the tribunal has firmly established that a developer's obligations extend beyond the initial paperwork. The ruling ensures that homebuyers at the Chembur project will have physical access to the parking slots they were promised, setting a precedent for other real estate developments across the region.
