Mumbai Court Rejects Rakesh Wadhawan Plea to Defer Patra Chawl Case Charges

The Mumbai Sessions Court has rejected a plea by applicant Rakesh Wadhawan to defer the framing of charges in the Patra Chawl redevelopment case. Special Judge Mahesh Jadhav ruled that the court will proceed with framing charges based on the material currently available, rather than delaying the legal process.
Through his defense lawyer Sagar Shetty, Wadhawan had filed a plea seeking a direction to ask the investigating agency to clarify the status of its ongoing probe. Wadhawan argued that if the investigation into the case was still underway, the court should postpone arguments on framing charges until the agency completed its inquiry.
Shetty submitted to the court that the investigating agency had explicitly stated in its main chargesheet that the investigation was still continuing. Specifically, the ongoing probe concerns the role of other accused individuals, alongside the end use and diversion of the allegedly defrauded funds.
The defense argued that forcing arguments on charges at this current stage would compel them to disclose their legal strategy prematurely. Shetty contended that this would enable the investigating agency to plug existing gaps in the chargesheet, creating a "cat and mouse game" that is not envisaged under criminal jurisprudence.
In response, Special Judge Mahesh Jadhav noted that the investigating agency had already clarified the status of its ongoing probe. The court highlighted that the investigation regarding Pravin Raut, who is allegedly linked to Shiv Sena (UBT) leader Sanjay Raut, was still continuing. The court also noted that Wadhawan's own discharge application remains pending before the court.
Rejecting the plea, the court stated that the charge will be framed on the material already filed by the investigating agency. Special Judge Jadhav remarked that it is not necessary to defer the stage of framing of charge at the whims of the applicant.
With the rejection of the plea, the court will proceed to frame charges in the Patra Chawl redevelopment case based on the existing evidence. The proceedings will move forward without waiting for the final completion of the investigation into other accused individuals or the diversion of the funds.
