Bombay HC Rejects Man's Divorce Plea Over Routine Marital Disagreements

The Bombay High Court has rejected a man's plea seeking a divorce on the grounds of cruelty, ruling that routine disagreements and normal marital friction do not qualify as mental cruelty.
A Nagpur bench comprising Justice Urmila Joshi Phalke and Justice Raj Wakode observed that disagreements are a normal part of married life and do not provide sufficient grounds to dissolve a marriage.
The court noted that mere annoyance, irritation, and ordinary disputes between spouses do not amount to mental cruelty under the law.
According to the bench, cruelty in a marriage must be of such a nature that it becomes unreasonable for the couple to continue living together.
Based on these observations, the high court rejected the husband's petition to end the marriage on the grounds of cruelty.
