Bombay HC Denies Divorce to Man, Rules Normal Marital Disagreements Not Cruelty

The Bombay High Court has refused to grant a divorce to a 44-year-old man who claimed his wife quarrelled with him and his mother, observing that mere annoyance, irritation, and normal disagreements in a marriage do not constitute mental cruelty or grounds for divorce.

A Nagpur bench of the High Court comprising Justices Urmila Joshi Phalke and Raj Wakode passed the order on Wednesday, August 19, 2026, while dismissing the man's petition. The bench upheld a family court order that had rejected his divorce petition on the grounds of cruelty and directed him to pay a monthly maintenance of ₹5,000 to his wife.

The court observed that with changing dynamics in marriage, cruelty cannot be determined by a few isolated instances and must be assessed across the entire married life as a whole.

"There have been marked changes in the life around us and also in matrimonial duties and responsibilities," the bench said, adding that cruelty in one case may not be the same in another. The judges noted that alleged cruelty may largely depend upon the type of life the couple leads, their economic and social conditions, and their culture and human values.

The bench noted that every marriage has its normal share of quarrels and disagreements, and mental cruelty has to be expressly distinguished from everyday disputes. Cruelty, the court held, should be of such a nature that the couple cannot reasonably be expected to live together.

"The allegations of cruelty cannot be considered on trivial issues. General allegations of cruelty do not constitute cruelty in the eyes of law so as to grant decree of dissolution of marriage on that premise," the High Court stated.

The couple married in 2003. In his plea, the husband claimed that his wife was short-tempered, regularly quarrelled with his mother over trivial matters, blamed him for not being able to conceive, and left the matrimonial home in 2011 after subjecting him and his parents to mental cruelty.

The wife denied the allegations, stating that her husband and his family had ill-treated her over not being able to conceive. She also stated that she had returned to her husband's home, but he had refused to cohabit with her.
