Bombay High Court Revokes FSSAI License Suspension of Park Inn by Radisson Navi Mumbai

On July 17, 2026, the Bombay High Court set aside the suspension of the FSSAI license of the five-star hotel Park Inn by Radisson in Navi Mumbai, ordering a fresh inspection of the premises by the Food and Drug Administration (FDA).

The Division Bench of Acting Chief Justice Ravindra Ghuge and Justice Gautam Ankhad directed the Commissioner of the FDA to form a committee to carry out the inspection on Saturday morning and submit its report by July 20.

While revoking the suspension order, the bench stated that if the report indicates the hotel has cured its deficiencies or is within tolerable limits, the suspension will be withdrawn permanently, allowing the hotel to continue its operations.

The legal dispute began after a Food Safety Officer conducted a surprise inspection of the Navi Mumbai hotel on the afternoon of July 2. The inspection resulted in a compliance score of 65 out of 108, representing a 61 percent rating for non-compliance.

Following the inspection, the Designated Officer of the FDA issued an order on July 3 suspending the hotel's FSSAI license with immediate effect. This order required the hotel to immediately stop all food business activities.

The hotel challenged the suspension through a petition filed by its authorized signatory, who was represented by advocates Mayur Khandeparkar, Shubhra Swami, and Sagar Shetty. The petition argued that the FDA's suspension order failed to provide any specific reason to bypass the standard procedure of issuing an improvement notice and giving the hotel time to resolve the issues.

The petition further contended that the suspension was based solely on a numerical compliance score of 61 percent, without any independent, qualitative finding that the deficiencies rendered the food served at the premises unsafe.
